The use of tribunal secretaries in international arbitration is controversial. Concerns over the scope of secretary responsibilities, the potential for challenges of the resulting award by the disgruntled party, and the issues of party perception and consent have had a chilling effect on their use. But as concerns over the time and cost of arbitral proceedings grow, many are reconsidering the benefits of the involvement of tribunal secretaries. This panel, composed of key arbitral institutions in New York and several currently-serving secretaries, will weigh in on market trends, the advantages and best practices for using secretaries, as well as risks and pitfalls to avoid.
